    • (b) entre le 1er janvier 1943 et le 1er janvier 1946, et le nom de l'auteur n'est pas connu pendant 70 ans après la publication, à compter du 1er janvier de l'année suivant l'année de publication.
  3. Cette œuvre est un film (un fragment vidéo ou un seul plan de celui-ci) :
    • (a) qui a été montré pour la première fois avant le 1er janvier 1943[2] ou
    • (b) qui a été créée par une « personne morale » entre le 1er janvier 1929 et le 1er janvier 1946, à condition qu'elle ait été présentée pour la première fois au cours de la période indiquée ou qu'elle n'ait été présentée que le 3 août 1993.
  4. Cet ouvrage est un rapport d'information (y compris un reportage photo), qui a été créé par un employé de TASS, ROSTA, ou KarelfinTAG dans le cadre des fonctions officielles de cette personne entre le 10 juillet 1925[3] et le 1er janvier 1946, à condition qu'il ait été publié pour la première fois en la période indiquée ou n'a été libéré que le 3 août 1993.

Cette œuvre se trouve dans le domaine public aux États-Unis, car elle était dans le domaine public dans son pays d'origine (Russie) à la date de l'URAA (1er janvier 1996), et il n'a pas été republié pendant 30 jours après les premières publications aux États-Unis.

[1] Si l'auteur de cette œuvre a été soumis à la répression et réhabilité à titre posthume, la durée du droit d'auteur est comptée à partir du 1er janvier de l'année suivante l'année de réhabilitation.
Si l'œuvre a été publiée pour la première fois après le décès (réhabilitation posthume) de l'auteur, la durée du droit d'auteur est comptée à partir du 1er janvier de l'année qui suit l'année de publication, à condition que l'œuvre ait été publiée dans les 50 ans après le décès de l'auteur (et non réhabilité à titre posthume) avant le 1er janvier 1943, ou dans les 70 ans suivant le décès (réhabilitation posthume) de l'auteur (réhabilité à titre posthume) entre le 1er janvier 1943 ans avant le 1er janvier 1946.
[2] Les films amateurs projetés pour la première fois le 1er janvier 1943 ou après sont les sujets des points 1 et 2 de ce modèle.

[3] Les rapports « ROSTA » créés avant le 10 juillet 1925 sont les sujets des points 1-2 de ce modèle.

Article 22. Protection Period of Copyright

1. The right of authorship, right of the name and right of protection of reputation of the author are protected termlessly.

The ownership rights remain valid during the whole life of the author and 50 years after his/her death, except for cases envisaged by the present Article.

2. Concerning an anonymous work or a work under the pseudonym the protection period makes 50 years after the moment of the first legal publication of the work.

At absence of legal publication within 50 years after the moment of creation of such work, the protection period makes 50 years after the moment of the first bringing of the work to universal knowledge upon the consent of the author in the form other than publication.

At absence of the above valid publication and any other bringing of the work to universal knowledge upon consent of the author within 50 years after the moment of creation of such work, the protection period makes 50 years after the moment of creation of the work.

If during the above period the author of an anonymous work or works under a pseudonym discloses his/her person, or his/her person does not leave any further doubts, clause 1 of the present Article shall be applied.

3. The ownership rights on a work created in co-authorship, shall act during the whole life and 50 years after the death of the last author who has survived over other co-authors.

4. Calculation of the periods envisaged by the present Article shall starts from January 1 of the year following the year, in which the juridical fact took place being the basis for beginning to calculate the period.

Article 23. Common Property

1. Expiration of operation period of ownership rights on objects of copyright or adjacent rights means transition of these objects into common property.

Objects of copyright or adjacent rights never protected in the territory of the Republic of Belarus are also considered as transited into common property.

2. Objects of copyright or adjacent rights transited into common property may be freely used by any individual or legal entity without payment of any reward. In this case personal non-ownership rights must be observed.
